Participant Release and Waiver of Liability

Location: Mobile Unit / Designated Event Space
1. Assumption of Risk
I understand that participating in a splatter paint or paint pouring session involves certain inherent risks, including but not limited to:

Physical Hazards: Slippery surfaces due to wet paint, tripping over equipment, and bumps or bruises in a confined mobile studio space.

Chemical/Allergen Exposure: Contact with artistic paints, cleaning agents, and blacklight/UV lighting.

Property Damage: Permanent staining of clothing, shoes, jewelry, personal items, or manicures.

Vehicle Risks: Entering and exiting a modified shuttle bus or commercial vehicle.

Impairment: Risks associated with participation while consuming food or beverages provided by third-party host locations.
I voluntarily assume all risks, both known and unknown, even if arising from the negligence of the releasees or others.
2. Waiver and Release of Liability
In consideration for participating, I, for myself and my heirs, hereby release and hold harmless Cosmic Splat LLC, its owners, employees, contractors, and the owners/operators of the host location property, from any and all liability, claims, or causes of action for personal injury, property damage, or wrongful death arising out of my participation in these activities.
3. Safety & Conduct
I agree to follow all safety instructions provided by staff. I understand that Cosmic Splat reserves the right to remove any participant who behaves in an unsafe or disruptive manner without a refund. I certify that I am not under the influence of any substance that impairs my physical coordination or judgment.
4. Medical & Light Sensitivity Acknowledgment
I certify that I am in good health and have no physical conditions (e.g., respiratory issues, severe light sensitivity/epilepsy triggered by UV lights, or skin allergies) that make my participation dangerous. In the event of an injury, I authorize staff to seek emergency medical treatment on my behalf.
5. Clothing and Personal Property
I acknowledge that the paints used are water-based but can be permanent on some fabrics. Cosmic Splat is not responsible for damage to clothing, footwear, jewelry, accessories, or manicures. Use of provided protective gear (smocks, booties, etc.) is at my discretion and does not guarantee total protection.
6. Governing Law & Severability
This agreement is governed by the laws of the State of Colorado. Under Colorado law (C.R.S. § 13-22-107), parents/guardians are permitted to release a child’s prospective claim for negligence for purposes of participating in recreational activities. If any portion of this agreement is found to be unenforceable, the remaining portions shall remain in full force.
